A track star that was trapped by the camera hitting his opponent in the head with a cane faces an assault load after the clip went viral.
The Commonwealth lawyer's office of Lynchburg told Dailymail.com that they have issued a petition for an assault and aggression position against Alaila Everett.
Everett was seen in the Indoor Track Championship in Virginia hitting Kaelen Tucker during the 4x200m relay event.
Tucker was running the second section of the relay for the Brookville High School in Lynchburg when he went to Everett of IC NORCOM High School abroad.
In the clip, you can see Everett pulling his right back and hitting the cane he carried by his opponent's head.
Before announcing the positions, the local NAACP branch issued a statement in defense of Everett.
In him, they said she was “was not an attacker” and described her as a “young leader and exceptional scholar.”
He added: “It has been carried out with integrity both inside and outside the field and any narrative that judges its guilty of any criminal activity is a violation of its due process.”

Everett had appeared earlier this week and said he has been at the end of death threats and racial attacks by the incident.
In an interview with Wavy.com On Monday, he started crying while giving his version of events about the viral incident.
She said: 'No one is going to believe me because I can admit for the video that looks like a purpose. But I know my intentions and never hit anyone on purpose.
'After a couple of times of hitting her, my cane got caught behind her in this way, and rolled her back. I lost my balance and, when I pumped my arms again, she was beaten.
Everett insisted that there is more in it, and the incident, of what appears in the short clip.
“They assume my character, calling me ghetto and racial insults, death threats,” he said. 'All this of a video of nine seconds'.

She added: 'Everyone has feelings, so you are physically injured, but you are not thinking about my mental (health).
On Tuesday, Lip Reading Expert Nicola Hickling revealed to Dailymail.com that Everett had shouted 'Get off' and 'Hey Oh' while hitting Tucker.
The judges at the meeting could see the attack and disqualified the NORCOM team for 'contact interference', or physically interfere with the actions of another corridor.
Tucker told local ABC Wset Affiliate: 'I still can't believe it, I'm in shock. I am still trying to assimilate everything, I can't believe it happened.
She added: “Why did you do it and why haven't you apologized?”
According to Wset, Tucker was treated by a brain shock and a possible skull fracture.
Tucker's mother, Tamarro, told Wset that no one from Norcom approached to see her daughter, or apologize.
'They do not apologize. There are no coaches. No athlete. There is nothing. Even if it was an accident, I don't think it were … nothing, '' he said.
