Jay ZHis lawyer says the rape charge against the rapper is sketchy… and he's seeking to have the case dismissed.
In new court documents obtained by TMZ… Alex SpiroThe attorney representing the rap mogul says he's preparing to file a motion to dismiss the lawsuit against Jay-Z… citing the statute.Jane DoeThe lawsuit only took effect after the alleged sexual assault… and cannot be applied retroactively against the rapper.
As Jay-Z's lawyer puts it…the law was passed in December 2000 – three months later after Jane Doe claimed she was sexually abused by Jay-Z Diddy at an MTV Video Music Awards afterparty.
Even if the law applies, Jay-Z's lawyer only covers conduct that occurred in New York City… and he insists that the alleged location of the alleged assault could not have been New York City.
He says Jane Doe claimed in her complaint that she was driven from Radio City Music Hall to a “large, white apartment building with a gated U-shaped driveway” about 20 minutes away… but Jay-Z's attorney says that each Residential building with this description – – if it had existed back then – it would be like this outside the territorial boundaries of NYC.
Jay's attorney doesn't stop there…he argues that all of Jane Doe's possible claims have expired – as early as August 2021.
It looks like the rapper's legal team is fighting hard to get the case dismissed.
